I have a situation where H & W hold their property in a Life Time Family Protection Trust along with two other named solicitors (both of whom have now retired) as the four trustees. H&W severed their joint tenancy and each of their shares are held in separate trusts with themselves as primary beneficiary and the other as secondary - with children and grandchildren as remaindermen.
Unfortunately W has now lost capacity and H would like to remove her from his trust as a trustee and beneficiary. Is this possible without a court application? He would also like to remove the retired solicitors and replace with his children.
Also, is it possible to remove W as trustee of her own trust without court application as she is primary beneficiary?
Any help/ideas would be very much appreciated.
