Probate Application Statement of truth

Hi All, Quick question

We have sent the probate division an affidavit of law of where the deceased was domiciled alongside the PA1A application.

They have come back stating they require a statement of truth at form 173 Tristram and Coote’s to proceed with the Application under Rule 30 (1)(b) non contentious probate rules.

I have looked through Form 173 in Tristram and Coote’s and that form is relation to minors.

Could anyone shed light which statement of truth I would need the persons entitled to the estate to sign

In our copy of the 31st edition form 173 is Oath for Administration (will) where deceased died domicilled out of England and Wales. It’s on page 1650 of that edition but does sound like it is the correct Oath for your situation.

Thank you Lyndzey, i am using lexis PSL and they have put form 173 as ’ Administration to guardians of a minor as personal representatives of the person entitled’
