My clients brother has passed away and left a property which he was renting out. He also has another property which was in bad condition and works needs to be done on it. The brother is willing to pay to get the property repaired but will he then be able to recover the money from the estate
Yes - in most circumstances.
If your client is an executor or administrator of the estate, he can recover the expense under his right to reimbursement.
If not, he can lend the funds to the actual executor/administrator
If there is no PR as yet (no will, no grant) he may need some form of agreement with the likely administrator/heirs.
