We have all come across situations where it appears there is no evidence that the NRB trust has been constituted, and the problems that then gives rise to.

Someone has to administer the estate and consciously constitute the trust. Without any administration of the estate the trust cannot be constituted. Without an administrator no-one can administer the estate. Therefore an administrator has to be appointed to
administer the estate and constitute the trust, whether by assent or resolution-but there has to be evidence it has been done, otherwise in 20 years time you will have an unconstituted trust,with interest running and a half share of the home then worth considerably
more, with perhaps a residue arising at that point, and all the mess that we are now having to deal with in these circumstances.

So as there is no executor, I would strongly advise you get a grant.
