I have been personally appointed as Executor and Trustee in a Will by a client. She was the beneficiary of her late husband’s estate, where one of the other beneficiaries was unhappy with the actions of the Executor and sought to have him removed. The same executor seeks to have me removed, by consent. From my research, I have not intermeddled, anticipating that I was next in the firing line. I have confirmed that I am happy to consent. Am I being overly cautious in wanting some form of indemnity from the incoming Executor? What form could this take?
