I ahve had a request for a meeting with an executor who has just spent the best part of £15k with a contentious Solicitor trying to get an affidavit from the witnesses as to the surroundings around the signing of the Will of the Deceased. The Executor is aware and has had confirmation from one of the witnesses (albeit verbal) that he was leaving as the other witness was arriving during the signing of the Will. However, they have refused to engage with the Solicitor and as a result the Executor is resigned to submitting the Will as it stands as she can’t afford to proceed with litigation to force a Statement of Truth from them (which they may lie about anyway)
However I am not sure whether I can act on that basis as the Legal Statement will be stating that she believes the Will to be the last valid Will of the Deceased. She won’t be able to sign that if she has suspicions that it isn’t the last valid Will.
Any thoughts or suggestions, please?
