Care fees and GROB

Hello

My clients are trustees of a trust of which their mother (91) is the only life tenant. She is in a care home but has full mental capacity. She has assets of her own of £500K+ and the trust has £500K +.

The trustees (her children) want to advance the entirety of the trust fund to themselves as remaindermen, and mother has consented to this. It will be a PET of course. If the children pay her care fees from the money they receive, could this be seen as a GROB. I am pretty sure not, but checking.

Thanks

Matthew
