We are in acting in a Probate matter where we have obtained Probate in respect of our deceased client. A part of the deceased’s estate comprises of a 45% share due from his late mother’s estate. The PR acting for his late mother appears to have not done anything in respect of the mother’s estate. We have written to her on a number of occasions for updates on the estate/distribution and have also indicated that if she fails to act she will lose the benefit of the RNRB and NRB but she still has failed to act (the mother passed in June 2024). We are conscious the PR’s failure to act will impact the amount due to the beneficiaries of our deceased client’s estate and the estates tax burden.
We have already entered a caveat and have come across applying for a citation. Has anyone had experience of applying for this and do you think this course of action is recommended in the circumstances? Are there any other steps that we could take?
