Claim to compensation

Dear All

Our client husband passed away in a Motor accident he had assets totalling under £5,000. However, a personal injury claim has been made by the surviving widow.

I understand that for estates that are valued under £5000 then no probate is required, however, would the widow require probate to obtain the compensation?

Yes, a grant is required in order to prove entitlement to compensation proceeds.

I suggest that you seek advice from a litigation expert.
My recollection from 40+ years ago was that claims then fell into 2 parts, one for the deceased [for pain and suffering - negligible for a “clean” kill] which required a grant, and one for dependents/family which was not part of the estate. However, I suspect that the law has moved on since then.
