Completing the update IHT418

Hello,

Has anyone had experience completing the new version of form IHT418?

I’m instructed in an estate administration where there are three executors appointed. However, only one of them is also appointed as a trustee of the trust from which the deceased benefitted.

I would be grateful for clarification on the following:

  1. Section C – Capacity: Given that only one executor is also a trustee, should that individual complete the form in their capacity as both executor and trustee, or should the form be completed solely in the capacity of executor?

  2. Declaration: Who is required to sign the declaration at the end of the new IHT418? Is it just the executor completing the form, or must all executors or trustees sign?

I’ve contacted the IHT helpline several times, but the advisors I spoke with were either unaware of the updated form or unable to provide guidance on these points.

Any insights or experiences would be much appreciated.

I’ve looked at the guidance which HMRC Provides, and it would seem to me that only the trustee who is also an executor needs to sign the document And complete it in their role as such.
