Court of Protection Deputyships assessment of capacity

I am making a Deputyship application for the sons of a lady to be appointed as her P and F deputies. As per usual I seem to be going around in circles in trying to arrange COP3 Assessment of Capacity. GP won’t do this as they say it is a legal matter. Social worker states that they will only do these when Local Authority is appointed as the deputy.

In terms of assets, this lady has lower threshold for care fees. However, her income will soon cause her capital to rise and fees will need to be paid. It seems that I cannot find anyone to complete COP3 without potentially £600 - £750 fee.

The care home manager has offered to complete this. He has NVQ qualifications in Care work and confirms he has training to complete cognitive assessments. I wondered whether this would be acceptable or whether there could be seen to be some kind of conflict.

There is also an agency which will complete for £200 - £250 but the assessment will be remote. I am not sure how successful this would be given the lady has dementia.

Does anybody have any experience of the COP’s attitude in these circumstances or can anyone suggest any alternatives. Your views would be most welcome.

We have used OFH Care https://www.ofhcare.co.uk/ who were very accommodating when we needed an assessment quickly, and travelled to the client’s home. The fee was £576 last November. The report was very detailed.

I don’t know if a care home manager would be acceptable to the COP and, like you, I wonder about a conflict of interest.
