Court Order for Incapacitated Person to take out Letters of Administration

Hi

My client would like advice on how to administer his sister’s estate who died intestate as her husband no longer has capacity. They do not have any children and the person who stands to benefit is her husband who like I say no longer has capacity.

Would the court issue a court order for the brother to seek the grant and if so does he need to be appointed as a Deputy to do this.
