I act for executors. Following issue of Grant of Probate, DWP launched an investigation into the Deceased’s entitlement to Pension Credit. It seems that £19,000 now needs to be repaid.
Does anybody know why the recovery period only starts in 2017 until date of death in 2023 despite us having provided historic statements showing a high capital level in 2010 (when the deceased had already been receiving Pension Credit since 2003).
The execs want to make payment to DWP but what assurance do we have that DWP can’t come back later and ask for more?
It is difficult to be able to communicate with what they describe as ‘Decision Makers’ at DWP so these questions can be asked. We waited about 24 weeks to get their decision. I am waiting for a more detailed breakdown but I expect it will take a long time to arrive.
Does anybody have any experience of these sorts of matters? Are there any experts / forensic accountants who can consider the calculations and /advise on whether it can be reopened in the future?
