DWP- Overpiad state pension

I have always understood it to be the case that DWP have no legal enforcement to reclaim overpaid state pension after death.

Today I phoned them to confirm this was still the case and the lady could not advise on this, in fact she said they could legally enforce the debt though if they tend to remove this after 12 months ‘if there are no funds to pay it’ indicating that if you have the funds you do need to repay this.

Most of my clients repay this anyway though in this circumstance there was not enough funds to cover all debts so I wanted the position clarified which didn’t happen.

I have attached an article from money saving expert (from 2022 mind) which confirms no repayment is needed and I wondered how everyone else looks at this position (not whether it is right or wrong not to repay but whether you must is you have funds too)
