Exec passed away before administrating estate, power reserved to another – do I need grant of double probate (CAPA5C)?

Hoping someone can help…

Exec passed away before administrating estate (deceased exec did not have a Will so no exec who can step in). On the initial grant there is power reserved to another (exec’s sister) – does exec sister now need to apply for a grant of double probate and if so, if the correct form a “CAPA5C”?

HI,

Yes, a CAPA5C will be needed, and a PA1P. If any IHT forms were submitted before the first Grant application, they should be resubmitted with any changes.
