Executor and Power Reserved

Good morning.

I have two execs. The 1st was instrumental in arranging matters since the death (six months ago); arranging property matters and collating papers etc. He has passed me all papers so that I could take instructions from 1st and 2nd exec and commence acting on their behalf.

1st exec could not attend the initial meeting due to ill health. 2nd exec confirmed he wished me to act. 1st exec now doesn’t feel well enough to continue with matters.

In terms of applying for the grant, I wanted to check that there is nothing to stop 1st exec taking a step back and having power reserved (despite his initial activities) and 2nd exec applying alone? It would only be an issue if 1st exec wanted to renounce?

I believe you are right. The requirement for intermeddling (or not) is only relevant if they want to renounce.
