Intestate sale of assets

We are working with a client whom the estate comprises of of two intestate claims. 50% share of the property per person.

All beneficiaries have been found and one side letters of administration have been granted.

There is dispute regarding the sale of the property by two of the beneficiaries.

Is permission required by all beneficiaries to proceed with the sale by the administrator?

Permission is not required by all beneficiaries to proceed with a sale by the administrator. It would be good practice for the administrator to liaise with the beneficiaries and take their wishes into account. In the event of a deadlock there is nothing to prevent the administrator proceeding with a sale.
