I’m looking for some practical guidance where H & W own several parcels of land jointly. W has lost capacity. H is sole attorney (registered LPA). H has power to appoint a trustee via the transfer. However, several transactions regarding property/ land are pending including the need to separate some titles and sell. Would it be more practical to make an application to the Court for an order appointing a second trustee in relation to all property interests of W or more straight forward to appoint a trustee upon each transaction via Trustee Delegation Act.
