Hi, I have searched the forum best I can to see if I can find opinions to the following
DT set up in Will “specified sum shall mean the largest amount that can be given by this clause without any inheritance being payable on the transfer of value of my estate which I am deemed to make immediately upon my death” Beneficiaries are spouse and children and issue.
Would this consist of the RNRB?. My view is not as the RNRB is not available on transfers into a DT and therefor IHT would be due but I may be wrong on the interpretation of this. Thanks
Yes, I agree with your conclusion that on the first death the maximum sum that could be given to a discretionary trust without inheritance tax becoming payable does not include the RNRB because - as you correctly say - an RNRB would not be available on a gift to a discretionary trust.
