My client has instructed me to prepare a finance LPA for them with me appointed as their attorney. I am not a partner of the firm (LLP) just a fee earning solicitor (we do not have a private client partner or member currently).
Would it be valid for one of my colleagues who is also not a partner or member of the firm to be the certificate provider?
I have looked at SI 2007/1253 and I know that you can’t be the CP if you are a ‘business partner’ or ‘employee’ of the the attorney but I can’t find clarity of whether ‘colleagues’ working for the same firm, fall into this exception?
