We have an estate in which 2 brothers (A & B) benefitted from their mother’s Will and were executors together with a partner of this firm. A lived with his mother and seemed to go along with the sale but when it came to vacate it, refused to do so. He was taken away eventually by a mental health team, who kept him for treatment. In the meantime, he was removed as an executor by the Court. The house eventually sold and A was eventually discharged from hospital but seemed to disappear without trace. We are still holding A’s share of the proceeds of sale and urgently need to trace him. Is it thought that A should bear the costs of this tracing as he knows the house is sold and that he is owed money but will not get in touch? We were aware that he was claiming benefits so maybe doesn’t particularly want the money!
I would appreciate hearing any views of other practitioners.
