IHT17011 indicates “The taxpayer or agent should complete a separate IHT409 for each arrangement.”
This implies that one copy of IHT409 should be completed for each pension. However if “NO” is answered to every question on the form, there is no option to identify each pension.
If there were Three Pensions each:
“with only small arrears of pension from the last monthly payment in the deceased’s lifetime to the date of death (you should show these in form IHT400, box 56)” - IHT409 Preamble.
- three copies of the same form would then have to be completed, each identical to the other with no reference to any pension. This appears to be daft, especially as there is no requirement to identify pension payments included in Box 56 on IHT400.
I have handled this issue by completing one IHT409 answering “NO” to each question and then putting a note on Page 16 of IHT400 to explain the pensions and amounts included.
Any comments please?
It is more logical to complete a separate IHT409 for a particular pension if “YES” is answered to any question.
