Online probate application

I am trying to submit a probate application online, and not sure if it’s a case of I can’t see the wood for the trees, but when I input the figures for the estate, I am receiving an error message stating that the net qualifying value cannot be more than the gross probate value. The NQV is £197,665.00 because there was a lifetime gift of £97k but the gross probate value is £104,000.00.

Has anyone had this issue before or can spot if I am doing something obviously wrong?

Thank you in advance.

My recollection of the last time I did an online application, is that you have two separate sections, one for the inheritance tax estate figures and one for the probate figures. Based on your figures, you would have the inheritance tax amount as Gross £201,000 and net £197,665 and the probate figures gross £104,000 and net £100,665.

Tell me if it works?

I believe the section of the application you are referring to only asks for the ‘estate for probate’ figures i.e. those that would be entered on an IHT421 if you were doing an IHT400. So it won’t include other taxable values such as survivorship property, PETs, foreign assets, etc

No it doesn’t. It asks for the estate for probate, estate for IHT and net qualifying value figures.

It is the ‘net qualifying value’ section which is causing the issue. But I have now been informed that there may be a glitch with the website.

But thank you for your response.

I have had this issue but have been unable to get through to HMCTS either by email or webchat. Have you been told that they are going to resolve this ‘glitch’ soon?

No, I have only heard this from other private client practitioners, not from the Probate Registry directly.

Hello - I have also had this error.
It did make me doubt myself but I emailed them at probatefeedback@Justice.gov.uk and have received the following:

Dear Corrinne,

Thank you for your email.

We are currently investigating an error in the system’s validation.

To resolve the error for now and submit the application, you could enter the estate’s net qualifying value as nil and then within the notes of the application (ie the page shown as at 3.6 of this guidance (if submitting a GOP application) https://www.gov.uk/government/publications/myhmcts-how-to-apply-for-probate-online/apply-for-probate-with-myhmcts#apply-with-a-will-grant-of-probate enter the true value so that it is then amended by a caseworker.

I hope this assists and sincere apologies for the inconvenience here.

Kind regards,

James Hellen
