Or would if living be

Lay person question

“every Person who may benefit is (or would if living be) a Beneficiary”
I have tried to find out what this actualy means if trust has a very wide class of beneficiaries.
I have checked my text books… and search on line and found it appears to be used in criminal law as well but no definition just were crops up.

Persons i believe can also mean none living persons legal entities with personality for example ltd company.

(or would if living be) does this mean beneficiaries that may be born and also beneficiaries that have died and the same for none living beneiciaries with legal personality?

thank you
Neil

Everything depends on context but this likely just carries its plain English meaning: any person alive or not yet born who could benefit under the terms of the trust.
It likely does not include the deceased as you cannot benefit a dead person. You can however make provision to benefit people who are not yet born.

Thank you Andrew, we were struggling to interpret the plain English and have different opinions.
