Hello,

I wonder if anyone could advise on this issue: Father (A) dies - only relative in the UK is child aged (14) - No will - The form says -

“Where there are persons aged under 18 benefiting from the estate then two applicants (or at least two) will be needed in Section A. You may wish to contact HMCTS Probate to seek information in regard to who is eligible to apply”.

The client called probate and they won’t provide information on “who is eligible to apply”! Which is rather unhelpful - they have referred the client to take advice from a solicitor.

Can anyone help on who is eligible to apply with the child?

It’s because it’s a Trust effectively. When I had this many moons ago it was mum and the deceased’s brother but effectively anyone can be appointed as the second Trustee as long as they are over 18, of sound mind and not bankrupt / likely to medal and interfere with the child’s money / their right to it.
