I am acting for widow (W) in preparing IHT Account and application for Grant. Her husband (H) set up 7 trusts in 2013 with a financial planning company. He is sole settlor of each trust with the trustees being H, W and one of their sons (S). All of the trust deeds state that £10 has been transferred to the trustees.
6 of the trusts have been executed by H but not by W & S. The 7th was not executed at all.
Q - as the sole trustee who executed the 6 trust deeds has died, is it too late for W&S to execute their parts of the deeds? If so, W can appoint new trustees as Executor of H’s Will.
