Power of appointment in pre 2006 IP settlement

Hi, I would be grateful if anybody can assist please.

The life tenant of a settlement dated 1990 has the power to appoint income to surviving spouse by will or codicil. Would the exercise of such power of appointment create a qualifying interest in possession trust or a relevant property regime trust?

I believe it would be a Transitional Serial life Interest and therefore a Qualifying Life Interest
