Would anyone happen to have any specific wording for box 2.16 of form PA1A where the applicant is a ‘first cousin once removed’?
I have consulted Tristram & Coote’s for a precedent but the furthest this seems to go is Cousin German. I have cobbled together an idea of wording, simply stating they are the son of the cousin who is the son of the uncle of the deceased and both the first cousin and uncle died in the lifetime of the deceased but it does not make for quite so easy reading…
I have had a few matters like this and have used wording similar to that which you have suggested. Grants have been issued and I have never received a query from the Probate Registry.
I am currently making an application for a first cousin once removed (cousin’s child). Did you respond to the question under Q 3.4 asking for confirmation that the applicant is a cousin of the deceased or leave this? Thanks in advance.
For the statement I used the precedent from T&C for Cousin German and just added to the start of it that the applicant was the son of the cousin.
For Q3.4 I indicated the number of whole blood aunts and uncles who survived (3.4(c)) and then how many actual cousins survived at 3.4(d) (there was one cousin still living). I then left the confirmation underneath blank as, strictly on the wording of the question, the applicant wasn’t one of the cousins and their parent wasn’t referred to at 3.4(c).
It was accepted with no issues or queries by the Probate Registry, even though there was an actual living cousin noted who could have taken out the grant (they were much older and didn’t want any involvement).
