I have a situation where a discretionary trust was created in 2001 and the family home was transferred into it. The husband-and-wife settlors and their two sons are the beneficiaries. The husband died some years ago and the property has now been sold as the wife has moved into a care home.
My question relates to RNRB and my thoughts are that there would be no RNRB available at the husbands death as he was not making an outright gift to lineal descendants. There is no life-interest. I do not believe that the wife would therefore be entitled to any RNRB either but would appreciate your thoughts.
