Tnrb query on death

I have a question. Mother passes away on 2012, everything passed to father.
On mothers death the only information children have is grant of Probate which says: gross value of the said estate in the UK does not exceed £325,000 and the net value of such estate does not exceed £79,000.

Can father who died recently claim mothers full NRB of £325,000 on her death with the above said? As failing to understand where mothers grant of probate in 2012 says estate does not exceed £79,000, does that mean some of the nrb was used up?

As you have a copy of the mother’s Grant of Probate, you can very easily obtain a copy of her Will from the official Probate Search website. The document will cost the princely sum of £1.50.

You will see from the copy of her Will whether she used any part of her nil rate band, for example, by leaving a legacy or other provision to somebody other than her husband.

Hi there was no will made by her. The grant of probate was needed at time due to some individual bank accounts held by her, but everything was passed to father.

How do we prove that none of the NRB was used, as everything was passed to surviving spouse at time
Thanks.

A Grant of Probate is only issued when there is a Will, so the Grant to which you referred cannot be a Grant of Probate.

Sounds like an Intestacy Bill. You really should seek professional advice.
