My clients wish to amend their Declaration of Trust, while I understand that this cannot be revoked and a new Deed drafted I was thinking that this could be varied however, can anyone point me in the right direction for a suitable precedent? Or if there is a better way that would be great.
Unless the document itself provides for a means of variation, s 57 TA 1925 and VTA 1958 are the only way. You do not say why the variation is desired. A trust is not like a contract which can usually be varied by the consent of all the parties. It can be terminated if all beneficiaries are ascertained and over18: Saunders v Vautier.
