I have a Will created by a gentleman, R, in contemplation of marriage to his opposite-sex partner, M; the Will was made in 2017. In 2023, R and M entered into a civil partnership. R has now died. Does the civil partnership revoke the Will?
I would say yes: s.18B(3) only says that civil partnerships don’t revoke a will if the testator was expecting to form a civil partnership; it doesn’t mention an expectation of marrying.
Am I right in thinking that the will was made before opposite-sex civil partnerships were introduced?
Thank you for your thoughts. Yes, opposite sex civil partnerships were introduced in 2019
