Is it possible to wind up a Will Trust where there’s a life Tennant beneficiary still living? If one Trustee-beneficiary doesn’t agree to do this?
If one of the beneficiaries doesn’t want the trust wound up, you can’t use SvV. Does the life interest trust include a power of appointment? I suppose the trustees could agree to appoint out everything to the life tenant if that’s the case.
Does the life tenant want to give up their life interest to the remaindermen and thus make a PET?
There is more than one way to wind up a trust so you need to provide further details.
